Fraud Act: Legal Guidance: The Crown Prosecution Service

The Fraud Act 2006 (the Act) comes into force on the 15 January 2007. It is based on the recommendations of the Law Commission report “Fraud” (Note:Law Com No 276 Cm 5560 2002) published in 2002. The Act applies in England, Wales and Northern Ireland.

The Act repeals all the deception offences in the Theft Acts of 1968 and 1978 and replaces them with a single offence of fraud (Section 1) which can be committed in three different ways by:

* false representation (Section 2);
* failure to disclose information when there is a legal duty to do so (Section 3);
* abuse of position (Section

I suggest that ********, among others during the period 2008 – 2009- performed poorly in relation to financial managment of my council investments. Particularly, as you can see from the report below, important information was missed and my council invested over 4.5 million in the iclandic bank AFTER they had recieved an email of there paid adviseres suggesting it ws unsafe ? I consider this failure substantial and the section 151 officer, as determined by our consitutional arraingements, is responcable
I also suggest that the initial investigation conducted by my council was flawed becase it involved people responcable for the failings.

A new tougher approach to collecting outstanding rent from ex-council tenants is being taken by North East Lincolnshire Council.They are a tracing and debt collection company who will start tracking down defaulters from the end of June.

The authority will pay Rossendales on a commission basis in the hope that some, if not all, of the money, owed to the council will be collected.
