I have written to you on a few occasions in relation to me attempting to find out some details in relation to our councils accounts, spends, and accuracy of figures presented to the public.

I have included a copy of my previous correspondence and some questions in the hope being able to get accurate and clear answers

I will break thee questions down into two sections and then have a last section for my comments and interesting results within the figures

Lastly, I will show you a walk through of how this type of management affected me, and why I think that its incorrect use of public money. Let me add that I stink that the failure within our council is down to personnel rather than rules.

And finally, this is what I suggest these figure show and why they have been presented this way

Included in page 3,7 of this document are figures I obtained from our council when I was investigating some actions taken against me. My involvement with the council and my interest in figures and numbers lead me to try and find out the following questions.

  1. In relation to the number of bills ( 07 = 81000 ) and the number of summonses for that year ( 11500 approx ) and the number of liability orders ( 8700 ) and the collection rate for that year ( 96 % )

    1.1 How is the collection rate calculated from these figures and when ( throughout the financial year ) does it represent.

I contacted you a while ago in relation to some concerns that I have in relation to my local council. I wander if you could help me get the figures that I am trying to realise.

The reason I request this is I am unsure about how our council worked out some of there results in relation to the collection of council tax and the costs involved.

I believe that our council recently was upgraded ( 2 star ) in relation to there results and I am concerned that ( certainly were council tax is concerned ) the results are unreasonably adjusted or have been purposefully skiwiffed to allow better results on paper.

Unfortunately, if what I am suggesting is correct, ( and I have researched it ), the public governed by my council have been decimated with costs ( close to one million a year ) .

Even more unfortunately for the public, most of the people on this list are either

, working but on benefits, working with children ( WFTC ), or single ( single person adult rebate ), or indeed just simply do not owe the council tax

Enclosed with this paperwork is a list of questions I have been trying to get answered in relation to these figures and I wander if you could assist me in getting these answered.

I have already requested this information from our council and haver been unable to get it.

I have a separate complaint being dealt with by the Local government ombudsman in relation to behaviour of some people employed by our council. The complaint involves some of the people that would be responsible for providing me this information

It looks very much like I will be taking our council to court as I only noticed what was going on in our council when they took action against me. ( bankrupted for the current years council tax and refused the right to pay )

This is the document I am referencing in the questions

Questions.

How are these figures made up

In relation to how many bills we send and how many people we take to court.

  1. how soon into the year do we take these people to court, ie. For 06 – 07 council tax our council tax took 11763 people to court, how was these spaced out over the year and what policy decides this. Who decides the grouping. ( Attached Page 1 and 7 )

  2. How Many of the people we take to court end up having the bills adjusted after the liability orders. Ie through benefit or corrections in liability ( page 2,3 )

  3. How does the successful collection rate for council tax ( 96% for 2006 ) account for the example account below. Is he a success or is he not counted

  4. How exactly are the figures for the collection rate worked out. I am fairly good with maths but am struggling to work it back. ( ie what all all the figures and adjustments used to produce this figure for each year )

  5. The court fund account ( £ 629,423 for 2006 – 2007 )

    5.1 Can I have a full input output for this account for all years.

I will tell you exactly what I am looking for and why.

5.1 How much is used to make re adjustment

I have asked our council this and they said it would be to hard to find out and I disagree. ( page 2 )

I trained in computer programming and I suppose you could say I sort of specialise in database. I understand how our councils system works ( I think ) and I believe that a well written search string should be able to pull out any current data and an analysing script should work with any archived accounts..

an account example so you understand what I am asking

Jo blogs lives in house liable for council tax from April 06.

Jo, misses his payment on the 1st of the month and receives a notice warning of court action on 13th April of that month. If joe does not pay by the end of the month he will receive a demand for the full years amount, saying he can not pay by instalments.

Joe starts making his payments as soon as he can afford it. Or is awaiting benefits and or adjustments or has some other concern over the accuracy of the amount or has things going on in his life that means he is busy around April ( divorce, bereavement, moving, etc ).

Joe is taken to court at the end of the second month and a liability order is gained

Jo’s cost are increased by ( 85 ) and he now owes for the full year and is unable to make instalment payments to the council even if he wants to.

Joes account is sent to the bailiffs ( rossendales ) and again his costs increase

All within the first three months of the year being charged for.

So, if joes circumstances change after this, or he is given a benefit ( council tax benefit or single adult rebate, ) he still has his court costs and ballifs fees to pay ( usually app 150 ) ( unless is refunded ). Is this marked as a successfully collection in our councils published collection rates

Questions about the 8000 council tax payers that are taken to court each year.

do our council know what type of people these 8000 are ( the figure seem quite constant )

Ie.

Could the 8000 be split into three basic groups

Group one.

People that get no benefit

Group 2

People on permanent Benefits

Group 3

Working people on benefits

The finances Generated (page 2 the collection account )

how is this figure spent, For each year

Why am I asking these questions.

I am interested in what a 96% collection rate includes, and who it includes.

Can the collection rates be divided into the groups

What have we done about reducing the amount of people taken to court each year.

What have we done to reduce the cost burden to the tax payer

The ballifs and solicitors we use.

How much do the people of north east lincs pay the bailiff’s each year

What or who within our council reviews spending and the cost to the public

What I am suggesting.

I am suggesting that our council, in an attempt to improve there score and collection rate of council tax have implemented a set of rules that have had a massive detrimental effects on the finances of working poor, the paying public.

I have been drawn into this because of a personal battle with my council in relation to them incorrectly charging me for other peoples houses that has lasted 5 years. Last year my council bankrupted me for the current years council tax.

I will contact you again after I have sorted out my personal dispute with my council as I have done a bit of a review of some of the published accounts and I have some questions

Re ; message left for me today with your assistant.

Dear Sir

I am just writing to ask you to clarify and confirm the detail of the message left for me this afternoon.

I contacted your department in relation to me getting a list of employees and i have asked for this officially on four occasions.

You have stated that I will be provided this under a freedom of information request.

Please can you give me the details so I can understand what request your are on about. The reason being is you have ( and confirmed ) completed every SAR and FOI request. For all requests of this nature there is a time limit for your answer so this Why I am asking you to detail what request it was from.

Have I requested this in the last 40 working days or, have you invoked the time machine again.

And please don’t think I am taking the mickey mentioning the timer machine. If you look through our correspondence I have mentioned it before and I will explain soon why.

3. who is responsible to the public for the management of this figure and the funds it generates

4. the figure is quite regular from 2003, has there been any reviews to see who ( what sector of the public ) is affected by this. IE ( do we make sure that this figure does not include many working poor )

Number of Liability Orders

1. how many of this number are already paying previous council tax’s under agreement or arraignment

2. what conditions/consideration are used to deicide whether to go to this stage.

3. who is responsible to the public for the management of this figure and the funds it generates

4. the figure is quite regular from 2003, has there been any reviews to see who ( what sector of the public ) is affected by this. IE ( do we make sure that this figure does not include many working poor )

5. How many of these liability orders end up being the same amount due from the public at the end of the year ( see example joe blogs )

6. Is someone that’s been served a liability order still a successful collection, ( re collection rate )
