A MAN has been jailed for 30 days after repeatedly refusing to pay his council tax.
Gavin Kaylhem, 34, of Lincoln Boulevard, Grimsby, was sentenced at Grimsby Magistrates’ Court after accruing a council tax debt of £1,268.54 between 2001 and 2008.
In refusing to pay, Kaylhem claimed that he was a “Freeman on the land” and had no contractual obligation to pay under Common Law.
North East Lincolnshire Council sent him 18 recovery letters and organised 12 bailiff visits, but Kaylhem returned several of the letters, writing “no contract” on them, and refused to recognise the legal authority of the court.
He failed to attend court twice this year, leading to his arrest, and when he was brought before the court, he refused to give his name, address or date of birth.
A council spokesman said after the hearing: “Kaylhem made clear his unwillingness to co-operate with the council and the courts, so the bench felt a prison term was appropriate in this case.
“We hope this sends out a clear message to others who may be minded to avoid payment. Council tax is enforceable in the courts and debts will be chased up.”
A spokesman for North East Lincolnshire Council said: "The council is keen to advise residents and help them with regards to their council tax bills, and a prosecution is always a last resort. When cases do go to court, defendants are usually given an order to pay the courts for their tax liability. However, Kaylhem made clear his unwillingness to co-operate with the council and the courts, so the bench felt that a prison term was appropriate in this case.
"We do hope this sends out a clear message to others who may be minded to avoid payment. Council tax is enforceable in the courts, and debts will be chased up."
I am not a supporter of the freeman of the land claim
Everybody thats working need to pay something. Anyomne who claims the freedom of the land defence deservese what they get.
Council tax is badley managed and badley focused. But it pays for the police, hospitals ect ect. If you had someone burgle your house, you would not expect the police to say ' sorry your a freeman of the land, sort it out yourself'
I think people claiming this defence do more damage to people who are genuinly trying to identify the faults in the systems.
I agree with what you say CC, but you have to wonder why so many get caught up in this "Freeman on the Land" doctrine.
My guess is the most outraged of the millions who have suffered injustice at the hands of councils (and Magistrates' courts they're in cahoots with) see this as a way of protest.
Let's face it, there's no means of redress with the council after their crooked bailiffs have defrauded or attempted to defraud residents who they say have defaulted on their council tax.
We know that the whole system is corrupt and the Local Government Ombudsman and Police turn a blind eye to the criminal actions of the council and their bailiffs.
In all honesty I think council officials are far more deserving of custodial sentences for extorting money in the name of council tax court hearings.
As expected, we see the moronic council spokesman's comments which of course, they can't resist adding to "send out a clear message to others".

Is the council incapable of selecting a suitable generic spokesperson comment for the appropriate story? We know the council's advice and help with his council tax is irrelevant here as we've read he refused to pay.

Not at NELC, prosecution is the first resort, way before checking the accuracy of the accounts.

The truth is, he has not even argued it correctly, some have had sucsees at court with this but you have to do it properly. IE formaly dis-assoseate yourself with your birth certificate, do the paperwork propertly for the court, make the legal standing that your a representative of the name refared to on the bill, and quote the appropreat laws.
