What mechanisms have been used to notify business of their
eligibility or potential eligibility of this since the introduction
and for each relative year ( 2005-2010 for each year please )

also ,

What department and who would be in the line of management for
ensuring this is administered properly. From the executive officer
down please

interested in how the council has tried to inform people of this.

Thank you for your request under the Freedom of Information Act made on
27th September 2010, reference number 20100943.

Under section 1 of the Act I wish to confirm that North East Lincolnshire
Council holds the information you have requested.

Your first question asked for the mechanisms used to notify businesses of
their eligibility or potential eligibility to small business rate relief
for each year between 2005 and 2010.

A leaflet with details on applying for the small business rate relief is
sent with the annual Council Tax and Business Rate bills and all bills
issued to new occupants.

Full details about Business Rates, including how to apply for small
business rate relief is available on the Council’s website at

information about Business Rates can be found on the Valuation Office
Agency website at [2]http://www.voa.gov.uk/business_rates/ind…

Information about the small business rate relief scheme has been provided
to the local Chamber of Commerce.

In additional to these advertisements have been placed in local newspapers
and a letter from the Valuation Office Agency was sent to all businesses
following the 2010 revaluation.

Your second question, asked what department is responsible for ensuring
small business rate relief is administered properly, and the line of
management for this.

The Business Rate section is responsible for the administration of the
small business rate relief scheme, this service is run by North
Lincolnshire Council for North East Lincolnshire Council under a shared
service agreement and managed from there.

The line management in North East Lincolnshire Council for Business Rates
is as follows

* Chief Executive (North East Lincolnshire Council)
* Executive Director Business Services
* Chief Finance Officer
* Income & Collection Manager

can i confirm that your stating this as facts for all the years i
have asked for ( 2005-2010 )and not just how you act now

1. A leaflet with details on applying for the small business rate
relief is sent with the annual Council Tax and Business Rate bills
and all bills issued to new occupants.

2. The Business Rate section is responsible for the administration
of the small business rate relief scheme, this service is run by
North Lincolnshire Council for North East Lincolnshire Council

Dear Ellis, Paul,

This did not happen for the years 2005-2008, ie you was not sending
this out with Bills, summones or liability orders with relevent
NNDR bills.

Please confirm what department stated this and if you have tried to
varify it at all.

I have in hand, three bills ( NNDR ) with all the paperwork ) from
these years, there is no application for SBR.

This first one of these i recived, i filled in ( 2010 )

The information provided to you came from and was verified by North East
Lincolnshire Council’s Income & Collection team.

To avoid confusion I would like to clarify the Council’s response for
you. The annual bills and all bills issued to new occupants have a
leaflet sent with them advising that details on applying for Small
Business Rate Relief are available from the local authority. We have not
said that application forms for applying for Small Business Rate Relief
are sent with these bills.

North East Lincolnshire Council do not hold copies of the leaflet sent
with Business Rate bills prior to the financial year 2007/08.

North East Lincolnshire Council do not hold copies of information that has
appeared in the local media with regard to Small Business Rate Relief or
details of the dates on which this information would have appeared.

The information in relation to the Small Business Rate Relief Scheme
provided to the local Chamber of Commerce was supplied to them by the
Department of Communities and Local Government, and North East
Lincolnshire Council do not hold a copy of the information supplied to
them.

I still need some part clearing up

The leaflet you say got sent out for 2005-2007 with nndr bills

on your website, there is a leaflet for council tax for these years

are you saying that a different leaflet was sent with NNDR bills (
not this one ) for them years and you dont have a copy of it. Or
was this the leaflet

secondly.

you say

Did our council pay for any advertising of the NNDR reduction, or ,
like this

I am pleased to acknowledge …….. provide the following information.

In response to your first question I am pleased to confirm that the
2006/07 Council Tax leaflet on the Council’s website was sent with the
2006/07 Business Rate
bills ([1]http://www.nelincs.gov.uk/GetAsset.aspx?…).

In response to your second question any advertising locally of the Small
Business Rate Relief Scheme or other reduction scheme would be paid for by
North East Lincolnshire Council, however as previously stated no
information is held by the Council of the advertising undertaken or the
dates of the advertisements. The Council have supplied local papers with
information on Business Rates including the Small Business Rate Relief
Scheme in relation to articles they have wanted to run, again no
information is held by the Council of the articles written or the date(s)
of publication.

i am asking the ICO to look at this because i feel your answers at
first were purposefully lax and incorrect. anyone using this
repsponce for research would be mislead into thinking your first
responses were true were they were not.

so

just to make this clear

when I asked you on 27th Sept

“what mechanisms…………..” And “ What department……..”

Your answers on 30th September “A leaflet with details on applying
for the small business rate relief is sent with the annual Council

As the leaflet sent with the bill this year does no mention SBR
discounts, just council tax ones

You were not answering on behalf of NELC, because NELC did not send
these, the government Did

This was incorrect, The other council took over the administration
of NNDR from NELC in “01/08/2007 ”

Also, I asked you to clarify on 1st October

On the 5th October you said

and you have answered confirm that the leaflet sent out for the
year 2005-2007 was the one on you web site that DOES NOT MENTION
SBR relief.

I feel you understood this all the time and just tried to misdirect
me.

this is the same with the notices sent by the Dept of commerce and
advertising in the local paper
